OSG sa SC: ibasura ang petisyon ni De Lima dahil sa falsification of documents

Hiniling ngayon ng Office of the Solicitor General (OSG) sa Supreme Court (SC) na ibasura ang petisyon na inihain ni Sen. Leila De Lima kaugnay sa umano’y iligal na paghuli sa kanya dahil sa kanyang kasong may kinalaman sa paglaganap ng iligal na droga sa New Bilibid Prison (NBP).

Ayon sa OSG, pineke umano ng senadora ang notarization ng kanyang petisyon.

Partikular umanong pineke ng senadora ang jurats na nasa verification at certification kontra sa forum shopping page ng kanyang instant petition.

Kabilang din umano sa mga pineke ay ang affidavit of merit na sumusuporta sa kanyang prayer for injunctive writ.

Ang jurat ay bahagi ng affidavit na nagpapakita kung kailan, saan at kung kanino sinumpaan ang salaysay.

“Petitioner falsified the jurats appearing in the: a) verification and certification against forum shopping page of the instant petition; and b) affidavit of merit in support of her prayer for injunctive writ. Consequently, the instant petition should be dismissed, and its concomittant application for temporary restraining order (TRO) and/or status quo ante order (SQAO) denied, pursuant to Section 4, in relation to Section 3 of Rule 7, of the Revised Rules of Civil Procedure,” base sa manifestation ng OSG.

Sa jurats ni De Lima sa kanyang petisyon, nanumpa ang senadora kay Atty. Maria Cecille Tresvelles-Cabalo noong Pebrero 24 sa Quezon City, ang araw din kung kailan hinuli si De Lima at idinitine sa PNP Custodial Center.

Pero sa manifestation ni Solicitor General Jose Calida na inihain sa SC, iginiit nito na ang umano’y abogado na nag-administer sa oath ni De Lima na si Atty. Cabalo ay hindi nakita sa Philippine National Police (PNP) Custodial Center sa parehong araw.

“The only chance for De Lima to swear in before her was to personally appear before Atty. Cabalo. However, De Lima is in prison and even the shadows of Atty. Cabalo was not seen inside the detention cell of the lady senator. Therefore, contrary to the allegations in the jurats, petitioner did not appear and swear before Atty. Tresvalles-Cabalo on February 24, 2017 in Quezon City.”

Dagdag ni Calida, nakakuha rin sila ng affidavit ni PNP custodial center chief Supt. Arnel Apub na isa sa mga respondent at inamin nito na wala si Cabalo sa Custodial Center noong dinala sa Camp Crame ang senadora.

Posible naman umanong maging ground sa disbarment kapag napatunayang pineke ng naturang abogado ang mga dokumento at puwede rin itong mapanagot ng indirect contempt na nasa ilalim ng Revised Penal Code.
